Relocation disputes are among the most emotionally charged and legally complex situations in family law. Parents who move — or plan to move — with children after separation frequently trigger legal proceedings that last 12 to 18 months and produce outcomes neither party anticipated.
Step 1: Do not relocate without written consent or a court order
Moving a child outside an agreed geographic area without the other parent's written consent or a court order is treated as child abduction under Irish and international law if the move crosses national borders. Even domestic relocation without agreement can result in an emergency court order requiring the child's return.
Step 2: Stop treating relocation as a personal decision
Courts assess relocation applications through the lens of the child's welfare, not parental convenience or career opportunity. A parent who frames the application primarily around their own circumstances — a new job, a new relationship, proximity to extended family — without addressing the child's existing relationships and stability, typically receives an unfavourable outcome.
Step 3: Do not give less than 3 months notice of intended relocation
Adequate notice allows the other parent to respond, negotiate, or apply to court before the move occurs. Short notice is interpreted as an attempt to circumvent the legal process and damages the applicant's credibility significantly.
Step 4: Avoid presenting relocation as final before court approval
Enrolling a child in a new school, signing a new lease, or resigning from employment before a court grants permission signals that the parent intends to relocate regardless of the court's decision. Judges treat this as contempt of the process.
